Act of Indecency
Act of indecency is not to be confused with indecent assault.
Indecent assault (under s61L of the Crimes Act) is where a person assaults another person and, before or after the time of the assault, commits an act of indecency on/or in the presence of that person.
Act of indecency (under section 61N of the Crimes Act) is where a person who commits an act of indecency with or towards another person, or incites that person to an act of indecency with or towards another person.
Acts of indecency are acts which a “right minded person would consider to be contrary to community standards of decency”. If the act has clear sexual connotations, the police do not have to prove the purpose of providing sexual gratification or the purpose of the indecent act. Indecency is that which offends against currently accepted standards of decency.
The penalty for act of indecency in the local court is a full time custodial sentence of 12 months and/or a fine of $2,200.
