Alibi notices
Where an accused person is not at a crime scene as the police allege when a crime is allegedly committed, he or she can raise the issue or defence of Alibi (i.e. they were somewhere else at the time the crime took place).
Where a matter is dealt with on indictment an Accused person must serve a “Notice of Alibi” on the prosecution within the prescribed period. If the notice is not served or is received by the Prosecution out of time, problems may arise in relation to raising Alibi at the trial.
In summary matters dealt with in the local court there is no strict requirement for the service of a “Notice of Alibi”.
