Q: Are You Facing A Committal?
A:
If you are facing a committal, you will have been charged with a serious
offence. A committal is the hearing in the Local Court. The magistrate decides
if the prosecution has enough evidence to send you for a trial or sentencing in
the District or Supreme Court. The seriousness of the charge means that it will
be unlikely for it to be settled in a Local Court.
You do not
have to enter a plea at the committal. If you plead guilty you may avoid a trial and
go straight to a sentence unless the prosecution wants to keep your case in the
Local Court. It is highly likely that if you plead not guilty or enter no plea,
that you will be committed for trial.
Because many committal proceedings sent for trial you need to act NOW to get the best advice and legal representation. Don't take any chances with your case.
