GRAFFITTI OFFENCES
It is an offence to deface property with a “Graffiti implement”, possess a “Graffiti implement”, posting bills or intentionally marking any premises.
It is also an offence to sell spray cans to persons less than 18 years of age.
Retailers must at law properly secure spray can paint.
It is a general defence if the act complained of was done with lawful authority.
Graffiti offences are generally governed by the Graffiti Control Act 2008.
It was recently amended by the Graffiti Control Amendment Act of 2009.
A new offence of supplying spray paint can to child has been created. Certain offences have increased penalties.
Rail safety officers can now demand a suspect's name and address.
