Habitual Traffic Offenders
As Traffic Lawyers specialists, we know how hard it is to pick up the kids from school, drop them off at soccer practice, or collect someone from the train station with a disqualified or suspended licence.
If you've accumulated 3 convictions for relevant offences within 5 years, you will be declared as a 'habitual offender' by the court. This causes a great deal of stress on families and work life as catching buses and trains are inconvenient, particularly if public transport can't be easily accessed or is unreliable.
Once the court declares you a habitual traffic offender, there is an automatic 5 years disqualification from driving in addition to any disqualification as a result from the third major offence. The automatic 5 year disqualification can be increased (you can be disqualified for life) or reduced to a minimum of 2 years.
Our traffic lawyers at The Criminal Law Centre have extensive experience with quashing the Habitual Traffic Offender declarations. We have a proven track record in having these matters dealt with quickly, efficiently and successfully.
The court generally looks at the disqualification imposed. If it is disproportionate and unjust when reviewing your total driving record and the court finds there are special circumstances, the Habitual Traffic Offender declarations will then be quashed.
Examples of "relevant offences" include a prescribed speeding offence, not being licensed while driving, disqualified or suspended (also by fine default) from driving and drink driving. At the Criminal Law Centre, our Traffic Lawyers can help get you back on the road or reduce the years you are disqualified from driving.
