Stealing
Stealing is a serious offence that breaches trust.
If the matter is finalised in the Local Court and the item that was stolen is valued:
- Less than $2,000: 12 months gaol and/or $2,200 fine
- Greater than $2,000 but less than or equal to $5,000: 12 months gaol and/or $2,200 fine
- Greater than $5,000: 2 years gaol and/or $11,000 fine
What do the Police have to prove?
The police must prove that you:
- Wrongfully took and carried away
- Goods of another person
- With the intention of permanently depriving (i.e. no intention of returning) the owner of the property
- Without their consent
What if I found the object?
If you have picked up an object as a result of finding it, the police must negate the possibility that the object was thrown away or abandoned and that you did not believe the owner could be found. What steps you take to find locate the owner will be taken into consideration.
