POLICE INTERVIEWS

Any person of interest (P O P) to the Police may be requested by the Police to make admissions or to be interviewed.

For this to occur , generally a caution will be administered by the Police. After it is administered any admissions made may be used by the Police.

The Police can interview by way of  various means including a Police not book entry, or an Electronic Interview of a Suspect Person (or E R I S P ) where a person is interviewed by a video recording apparatus .

Generally any Police admission made voluntarily is admissible in evidence.

The admission can , under certain circumstances be admissible in evidence even if it is obtained by the Police improperly or Illegally.

In certain situations a person must answer certain questions put to them by the Police.These situations include where a Police officer requests certain or required particulars of a motor vehicle crash, and where a Police officer has a suspicion based on reasonable grounds that a person whose identity is unknown to the Police officer to disclose his or her identity if the Police officer suspects on reasonable grounds that an apprehended violence order has been made against the person.

It is essential that no admissions be made by anyone to the Police unless they first receive independent legal advice.

At the Criminal Law Centre we are available to attend a Police station if the Police want to interview you.
