Murder
Murder is the most serious of assaults carrying the maximum penalty of life imprisonment.
Murder is when an accused:
- Has an intention to cause death to someone, and because of something they do or fail to do, causes death;
- Has an intention to cause grievous bodily harm to someone, and because of something they do or fail to do, causes death; or
- Knowing that what they are doing or failing to do will probably cause the death of or grievous bodily harm to someone, and they don’t care whether death or grievous harm is caused or not.
Each of 1,2 or 3 are tested against the accused’s actual state of mind. Sometimes, the charge can be reduced to manslaughter.
