Welfare/Centrelink Fraud
These matters are very serious. You should not say anything to the police or investigating authority, whatsoever without first obtaining legal advice. These offences regularly occur and, generally, the issue here is the knowledge or recklessness of a defendant, when receiving benefits and completing the appropriate forms and any other form of notification requested by Centrelink.
The often quoted authority is Barbara Robyn Winchester NSWCCA 28 February, 1992. In cases of fraud upon the social security system, a gaol sentence should be imposed unless there exist very special circumstances justifying some lesser punishment. Regina v David Fernanda Medina (CCA, 28 May 1990, unreported) followed.
